1. Glossary

Content: User-provided content, owned by the User or for which they have the right to provide, for commercial exploitation through the tools offered on the Breakin' Hub Platform, in various formats such as videos, audios, texts, presentations, files, links, and more.
Breakin’ Hub Platform: designates the technological platform, accessible at the electronic address www.breakinhub.com or through our official applications, which allows Users to register, store, or make content available, whether in the format streaming ou on demand
User: term used to refer to individuals who use the Breakin' Hub Platform.

2. Content Moderation

The Breakin' Hub Community Guidelines specify the types of content that are not allowed, so that Users understand the rules they are subject to, and also so they can contest improper removals. 
We know that this is a complex topic, so it should be built in collaboration with our user community. Suggestions for improvements and changes can be sent via email: hello@breakinhub.com
To facilitate the community's understanding, the content subject to moderation by Breakin' Hub is categorized by themes:

2.1.1. Intellectual Property

If the User believes that any content generated by third parties violates intellectual property rights to which they are the owner or, in good faith, believe they are, they may send Breakin’ Hub an extrajudicial communication or notification requesting that such content be removed from the Breakin’ Hub platform, or that access to it be blocked;
After receiving the notification or communication, Breakin’ Hub will remove or block the content that allegedly violates intellectual property rights and will immediately notify the user responsible for publishing said content;
Breakin’ Hub sporadically monitors the events published on its platform, although there is no legal obligation to do so;
Breakin’ Hub is not responsible for content generated by third parties that may infringe on intellectual property rights.

2.1.2. Deceptive and/or Abusive Advertising

We do not allow content that presents advertising:
"Deceptive," understood as any form of advertising information or communication, wholly or partially false, or in any other way, even by omission, capable of misleading the consumer regarding the nature, characteristics, quality, quantity, properties, origin, price, and any other data about products and services. (e.g., content that guarantees that the User will become rich in a short period of time; content advertising "miraculous" products and services).
or;
"Abusive," understood as advertising of any discriminatory nature, inciting violence, exploiting fear or superstition, taking advantage of the impaired judgment and experience of vulnerable individuals, disrespecting environmental values, or capable of inducing the consumer to behave in a manner harmful or dangerous to their health or safety. ( content that promises that the User will lose weight in a short period of time through techniques capable of causing harm to their health).

 2.1.3. Incitement to violence, Intimidation

We do not allow content that constitutes a threat, intimidation (bullying), insult, or is capable of shaming an individual or a specific group. Furthermore, content that involves doxxing (publishing confidential data of third parties), revenge porn, trolling, cyberbullying, or any other form of abuse will be removed.

 2.1.4. Terrorism

Contents created by terrorist groups or with the aim of radicalizing or recruiting individuals for the practice of illegal or violent acts will not be allowed.

 2.1.5. Prohibited or Regulated Products and Services

Breakin' Hub will not allow content that instructs or teaches Users to produce, manufacture or in any way create explosive devices, incendiaries, firearms, or any other product whose production or commercialization is prohibited or regulated (e.g. drugs and hallucinogens) , or even instruct Participants to provide services prohibited by law. 

 2.1.6. Nudity, Obscene Act or Sexual Exploitation

Breakin' Hub does not allow any pornographic or sexually explicit content that:

  • Portray a sexual act in an explicit manner;

  • Contains nudity in a sexualized context;

  • Is intentionally intended to cause sexual stimulation;

  • Promote, offer or advertise sexual or erotic services, such as prostitution, erotic massages, escort services, erotic shows, or performed in erotic entertainment venues. Eventually, Breakin' Hub may allow such content, as long as it has a clearly artistic, academic, scientific, educational nature or is used outside of a sexualized context.

Examples of permitted content ::

  • Artistic performances supported by government and/or institutional notices.

  • Chats, workshops, workshops, conversation circles and exhibitions, as long as they are theoretical.

  • Documentaries that present explicit content outside of a sexualized context.

  • Nudity in indigenous communities, during medical procedures, childbirth, artistic performances or breastfeeding, as long as they are contextualized and without the objective of promoting sexual stimuli.

  • Nudity outside of a sexualized context and with censorship mechanisms, such as blurring or disturbances.

  • Body art, as long as private parts are censored or covered.

  • Content that portrays swimwear outside of a sexualized context.

  • Real-world art that depicts sexual life.

  • Content published in a humorous or satirical context.

Examples of NOT permitted content ::

  • Clips taken from non-pornographic films or programs to isolate sexual scenes.

  • Content that portrays or promotes fondling and masturbation.

  • Portrayals without consent, even if outside a sexualized context.

  • Provocative or sexual dance, focusing on intimate parts and aiming to promote sexual stimulation.

  • Content with sexual abuse or assault.

  • Any forms of offering sexual services.

  • Use of sex toys not related to sex education.

  • Content that presents, promotes, normalizes or glorifies sexual violence.

  • Content that contains sexually explicit language for sexual gratification.

 2.1.7. Hate Speech

We do not allow content that contains hateful or discriminatory speech. By “hate speech” we mean any expression or speech directed at an individual or group of individuals that: (i) discriminates against such individual or group based on a personal characteristic (e.g. ethnicity, gender, sexual, political or religious orientation, age or disability); (ii) denote inferiority or disregard for that group or individual (e.g. segregation policies, racial superiority, etc.).

 2.1.8. Misinformation (“Fake News”)

Breakin' Hub will not allow the publication of demonstrably false or misleading content that is capable of causing public harm, such as threats to democratic political processes and legally protected assets, such as public health or safety (e.g.: content that contradict recommendations from official or international public bodies; content that denies historical events, etc.).
Breakin' Hub respects the right to freedom of expression and understands that there is a fine line between fake news, misinformation, satire and opinionated or journalistic content. Therefore, when analyzing such content, Breakin' Hub will preferably seek to guide the User in adjusting the content, in order to make it clear that it is opinionated content, rather than promoting its immediate removal.

 2.1.9. Manipulated Media (“Deep Fake”)

We do not allow the provision of content that contains media (image, audio, video or text) manipulated, altered or edited with the aim of causing damage to third parties or that violates the rights of third parties.

 2.1.10. Crime against the honor of a third party

Breakin' Hub does not allow defamatory, slanderous or insulting content, or content that makes false statements about a specific person, regardless of their status as a public person or not, capable of causing any material or moral damage. 
If the content is directed against a public person, Breakin' Hub reserves the right to request evidence capable of demonstrating that the content is false, especially if the published content has journalistic purposes. 

 2.1.11. Abuse or exploitation of a minor

We do not allow content created through the exploitation of minors or that is harmful to children and adolescents, such as content that contains child pornography, that sexualizes children and adolescents, or that encourages minors to carry out acts or activities that pose a danger to their physical health and mental.

 2.1.12. Illegal Marketing Practices and Fraud

Breakin' Hub does not allow content that presents Multilevel Marketing practices considered “pyramid” schemes or those created with the aim of obtaining, for oneself or another, an illicit advantage, to the detriment of others, inducing or keeping someone in error, through artifice, ruse or any other fraudulent means.

 2.1.13. Illegal or irregular events

Breakin' Hub does not allow the publication of events considered illegal or irregular, that is, that do not completely follow state and municipal guidelines for holding events in the state where it will be organized.

Therefore, it is mandatory to consult the protocols for preventing COVID-19 in the municipality and state where the event will be held and include them in the event description. Breakin' Hub suggests that the User access the official website of the City Hall and the State Government to consult the current protocols. Compliance with these guidelines is mandatory and the User's responsibility and events that violate applicable COVID-19 protocols may be removed.

 2.1.14. Payments outside the platform

In relation to event announcements, Breakin' Hub is not responsible for payments made to event organizers outside of our platform. Therefore, Users should not enter bank details in the event description or share links that direct to payment methods outside the platform.

 2.1.15. Partisan content

For the purposes of this document, Breakin' Hub will consider all events or content related to political parties, candidates, pre-candidates, elected politicians and other civil or legal personalities, directly linked to political parties, as partisan.

In view of the series of specific requirements to be met under electoral legislation for holding events or publishing content, compliance with these requirements will be the sole responsibility of the User. 

Breakin' Hub does not allow the holding of any events or the provision of content for electoral purposes, such as fundraising or advertising, especially during the election period. To this end, we recommend a detailed description of the scope and objectives of the event and/or content in the page description, in order to avoid other implications, such as moderation.

 3. Content Analysis

In our content analysis process, we take into account principles, consolidated standards, jurisprudence and the entire context in which these contents are inserted, to then decide whether there is a valid reason for their removal. To this end, we can analyze other related content that is outside the Breakin' Hub environment, as well as user activities and behavior on other social networks, and also any reaction of participants in relation to such content, or the public repercussion of these.
Users will be able to provide content that does not violate Breakin' Hub's Terms and Policies, but that is restricted to a certain age group. In this case, the User must clearly and expressly include in the event description the age group for which the content is intended, especially if it is content unsuitable for minors.
As stated, context is fundamental for analysis in Breakin' Hub, since content that has a clearly artistic, academic, scientific or educational nature may also contain explicit content. Therefore, in order to allow these types of content on the platform, consider improving their contextualization, through some measures, such as:

  • Indicate the purpose and historical setting of the content.

  • Include an explanation of the explicit content published.

  • Inform, in the description and/or title, the objectives of the content in a clear and legitimate way.

  • Insert, in the event title, the classification for content aimed at adults, as well as configure the age of majority validation in the personalized registration form.

  • Insert, in the description of the content, elements that justify the classification of the content as artistic, scientific, academic or educational, such as, for example, indication of cultural and/or institutional support, use of academic and/or scientific references in the editorial, description of how the content intends to add value to the user or society, defining the educational or instructive nature of the content, among others.

  • Use a transparent and coherent approach in describing content in relation to what it represents.

  • Use techniques to reduce the impact of explicit content, such as video cuts, photo blurring or audio censorship.

  • Avoid using titles, hashtags and keywords that highlight only the most provocative or explicit aspects of the content.

  • Avoid shocking or repulsing spectators.

  • Avoid focusing on the explicit part of the content, such as zooming, repeating and other editing techniques that aim to glorify a violent act or promote sexual stimuli. Contextualization is essential to help the user understand your content, as well as to help the Breakin' Hub team itself to analyze it.

 

4. Reports

Reports about the illegality of content or its violation of our Terms and Policies may be made by anyone and will only be analyzed if submitted through our official channels.

 

5. Content Removal, Suspension and Deletion of Accounts

Violation of Breakin' Hub's Terms and Policies may result in a request for adjustment or removal of content, as well as the suspension or removal of the user's account. This last measure will be taken by Breakin' Hub only in serious cases, in which the user, intentionally or repeatedly, violates the Terms and Policies, or when making extremely inappropriate content available. 
If the user account is removed, the creation of a new account is prohibited. If Breakin' Hub finds that the user who had their account removed has created a new account with false personal data, we reserve the right to delete such account.

 6. Appeal

If the user receives a message or notification from Breakin' Hub, through our official channels (support@breakinhub.com), requesting the adaptation of the content, or if the content has been removed, and believes that Breakin' Hub has made an error in its analysis and moderation, this user may appeal such decision, within 48 (forty-eight) hours, counting from the sending of the notification or the removal of the content.

In this appeal, the user must present all arguments and evidence that demonstrate that the content does not violate our Terms and Policies. Once received, we will analyze the appeal, through a panel made up of 2 people different from the one who made the original decision, within a period of up to 72 (seventy-two) hours.

Once the appeal has been analyzed, the result may be: (i) full approval with publication of the content in its entirety; (ii) partial provision, with the publication of the content, provided that any suggested adjustments are observed; (iii) dismissal, resulting in the permanent removal of the content with the suspension or exclusion of the user.

 7. Legal Effects

Decisions made by Breakin' Hub regarding the illegality of content or violation of our Terms and Policies are definitive for the use of our services, but are not, however, exhaustive, with the possibility for the user who felt harmed to take legal action that you understand as appropriate.
